Terms & Conditions

The following terms and conditions apply to all merchandise (referred to as the “Goods”) purchased from Sios, Inc. (referred to as “Sios”). The party purchasing the services or Goods from Sios is referred to as the “Buyer”. Sios may at any time revise these terms and conditions and Buyer is bound by any such revisions.

1. PRICE

Sios reserves the right to change, without notice, the published list prices referenced in this catalog. Prices do not include tax or shipping charges.  Buyer will be responsible for any applicable taxes.

2. TYPOGRAPHICAL ERRORS

In the event a product is listed at an incorrect price or with incorrect information due to typographical error, Sios reserves the right to refuse or cancel any pending orders placed.

3. PAYMENT TERMS

Sios may elect to extend, limit or revoke credit terms to Buyer at its sole discretion. Buyer has 10 days to notify Sios, in writing, of any invoice discrepancies.

4. LATE PAYMENTS

If payment is not received by the due date, Sios reserves the right to impose a service charge at the rate of 1 percent per month (12 percent per year) or the maximum legal rate, whichever is less, on unpaid invoices from the due date.

5. COLLECTION FEES

In the event of any litigation arising out of Buyer’s failure to pay, Sios will be entitled to recover from Buyer all of its reasonable expenses incurred in the collection of such amount.

6. ORDER ACCEPTANCE

Buyer is wholly responsible for the actions of Buyer’s employees, agents or representatives.  If an employee of Buyer places an order unbeknownst to its management, Buyer is responsible for said person’s actions, and Buyer assumes all responsibilities, whether authorized or not.  Buyer accepts the terms and conditions of the sale with Sios.  

7. DELIVERY

Delivery of the Goods will be F.O.B. Hauppauge, NY. Sios is not responsible for the delay of any shipment or delivery of Goods which are not within the control of Sios. 

8. RETURNS & EXCHANGES

Your total satisfaction is important to us. In the unlikely event that you are not completely satisfied with one of our products, returns are gladly accepted within 30 days of receipt of goods.  All returns must be pre-authorized by Sios and accompanied by a Return Merchandise Authorization (RMA) number. Please contact Sios Customer Service for a RMA  number at 855-644-SIOS (7467) or via e-mail at orders@Sios.com.

Discontinued products and products that have been opened and/or used will not be eligible for return. Buyer is responsible for shipping charges of all returns.

A 20% restocking fee may be applied to returns for such reasons as inventory balancing, canceled orders or incorrect merchandise ordered. All products returned to Sios due to refusal of acceptance by Buyer, without prior Sios authorization, may also be subject to a 20% restocking fee and shipping charges.

Should the buyer choose to exchange for another comparable product, the buyer will be responsible for additional shipping charges.

9. CLAIMS & LIABILITY

Claims for product damaged in transit or shipment shortages must be made to Sios within five days of receipt.  Request for proof of delivery on shipments must be made within 30 days of invoicing.  

If Buyer notifies Sios in writing of a claimed defect within the warranty period, Buyer will give Sios the opportunity to investigate the claim and to inspect allegedly defective Goods. 

If Sios determines that Buyer’s claim is valid, Sios, at its sole discretion, may repair, replace or issue credit for the defective Goods.
